Welcome to the MyDavis Predictions Market (“Service”), operated by MyDavisCalifornia (“we,” “us,” or “our”) at predictions.mydaviscalifornia.com. By accessing or using this Service, you agree to be bound by these Terms of Service (“Terms”). If you do not agree, do not use the Service.

1. What This Service Is

The MyDavis Predictions Market is a community engagement platform that allows registered users to make predictions on the outcomes of local Davis, California ballot measures and civic events using a virtual currency called “MyDavisCoins.” This Service is designed for entertainment and community engagement purposes only.

This Service is NOT a gambling platform, a financial exchange, a securities market, a regulated prediction market, or a betting service. No real money can be won, earned, or cashed out through the use of MyDavisCoins.

2. MyDavisCoins

MyDavisCoins are virtual tokens used exclusively within the MyDavis Predictions Market. By using this Service, you understand and agree to the following:

  • MyDavisCoins have no monetary value whatsoever. They are not currency, securities, commodities, or any form of financial instrument.
  • MyDavisCoins cannot be redeemed, exchanged, or converted into cash, credit, real currency, or anything of monetary value at any time, under any circumstances.
  • MyDavisCoins cannot be transferred between users or to any third party.
  • MyDavisCoins are non-refundable. All donations made to obtain MyDavisCoins are final.
  • We reserve the right to modify, limit, or reset MyDavisCoins balances at any time, with or without notice.
  • MyDavisCoins may be forfeited if you violate these Terms.
  • We reserve the right to discontinue the MyDavisCoins system or the Service at any time.

3. Free MyDavisCoins

New users receive 100 MyDavisCoins at no cost upon registration. These free coins are subject to the same terms as all MyDavisCoins and carry no monetary value. We reserve the right to modify or discontinue the free coin offer at any time.

4. Donations

Users may obtain additional MyDavisCoins by making voluntary donations to MyDavisCalifornia through PayPal or other payment methods we make available. By making a donation, you understand and agree that:

  • Your payment is a voluntary donation to support MyDavisCalifornia and its local community journalism, content creation, and community engagement activities.
  • Donations are processed by third-party payment providers (such as PayPal). We do not store your financial information.
  • All donations are final and non-refundable. No refunds will be issued under any circumstances, including but not limited to: dissatisfaction with the Service, account termination, Service discontinuation, or changes to the MyDavisCoins system.
  • The MyDavisCoins you receive in connection with a donation are a token of appreciation for your support, not a product or service being purchased.
  • MyDavisCalifornia is not a registered 501(c)(3) nonprofit organization. Donations may not be tax-deductible. Consult your tax advisor regarding the deductibility of your donation.
  • Minimum donation amount is $10.00 USD.

5. Eligibility

You must be at least 18 years of age to use this Service. By creating an account, you represent and warrant that you are at least 18 years old and have the legal capacity to agree to these Terms.

6. Account Registration

To use the prediction features of this Service, you must create an account by providing a display name and email address. You agree to provide accurate information and are responsible for maintaining the confidentiality of your account. You are solely responsible for all activity that occurs under your account.

7. Predictions and Outcomes

  • Predictions made on this platform are for entertainment and community engagement purposes only.
  • Prediction prices and percentages displayed on the platform reflect the aggregate activity of users and are not polls, surveys, forecasts, endorsements, or guarantees of any outcome.
  • We make no representations or warranties about the accuracy of prediction prices as indicators of actual outcomes.
  • We reserve the right to resolve, cancel, void, or modify any prediction market at our sole discretion, including in the event of ambiguous outcomes, changed circumstances, or errors.
  • MyDavisCoins awarded as a result of correct predictions carry no monetary value and are subject to all terms stated in Section 2.

8. Prohibited Conduct

You agree not to:

  • Use the Service for any illegal purpose or in violation of any applicable law
  • Attempt to manipulate prediction markets through fake accounts, automated systems, or coordinated activity
  • Create more than one account to obtain additional free MyDavisCoins
  • Reverse engineer, hack, or attempt to gain unauthorized access to the Service
  • Use the Service to harass, defame, or harm other users
  • Misrepresent your identity or affiliation
  • Use the Service for any commercial purpose without our prior written consent

9. Intellectual Property

All content, design, code, graphics, and materials on this Service are owned by or licensed to MyDavisCalifornia and are protected by applicable intellectual property laws. You may not reproduce, distribute, or create derivative works without our prior written consent.

10. Disclaimers

THE SERVICE IS PROVIDED “AS IS” AND “AS AVAILABLE” WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT. WE DO NOT WARRANT THAT THE SERVICE WILL BE UNINTERRUPTED, ERROR-FREE, OR SECURE.

WE ARE NOT AFFILIATED WITH THE CITY OF DAVIS, YOLO COUNTY, ANY DEVELOPMENT PROJECT, ANY POLITICAL CAMPAIGN, OR ANY GOVERNMENT ENTITY. The inclusion of any ballot measure, development project, or civic event on this platform does not constitute an endorsement or opposition to any measure, project, candidate, or position.

11. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, MYDAVISCALIFORNIA AND ITS OWNERS, OPERATORS, EMPLOYEES, AND AGENTS SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES ARISING OUT OF OR RELATED TO YOUR USE OF THE SERVICE, INCLUDING BUT NOT LIMITED TO LOSS OF DATA, LOSS OF MYDAVISCOINS, OR INABILITY TO ACCESS THE SERVICE.

OUR TOTAL LIABILITY FOR ANY CLAIM ARISING FROM OR RELATED TO THESE TERMS OR THE SERVICE SHALL NOT EXCEED THE AMOUNT YOU HAVE DONATED TO US IN THE TWELVE (12) MONTHS PRECEDING THE CLAIM.

12. Indemnification

You agree to indemnify and hold harmless MyDavisCalifornia, its owners, operators, employees, and agents from any claims, damages, losses, liabilities, and expenses (including reasonable attorneys’ fees) arising out of or related to your use of the Service or violation of these Terms.

13. Changes to These Terms

We reserve the right to modify these Terms at any time. Changes will be effective upon posting to this page with an updated “Last Updated” date. Your continued use of the Service after changes are posted constitutes your acceptance of the modified Terms.

14. Termination

We may suspend or terminate your account and access to the Service at any time, for any reason, with or without notice. Upon termination, your MyDavisCoins balance is forfeited and no refund of any donation will be issued.

15. Governing Law

These Terms shall be governed by and construed in accordance with the laws of the State of California, without regard to its conflict of law provisions. Any disputes arising under these Terms shall be resolved exclusively in the state or federal courts located in Yolo County, California.
